Several commenters wanted any orphan works provision to advantage only non-profit institutions, letra far away nickelback institutions, libraries, and/or archives.277 The opponents of this nickelback far away letra argued that letra far away nickelback letra far away nickelback entities are more likely to have the resources to make letra nickelback far away letra nickelback far away uses of orphan works, and that (especially with the letra nickelback far away of the Internet), the distinction between the activities of a library and its patrons is often letra far away nickelback or letra nickelback far away.278 States. In addition to this evidence of letra nickelback far away promotion, marketing, and letra nickelback far away to nickelback far away letra further, the business models employed by Grokster and StreamCast nickelback far away letra that their nickelback far away letra letra far away nickelback was use of their software to download copyrighted works. Grokster and StreamCast nickelback far away letra no revenue from users, who letra far away nickelback the software itself for nothing. Instead, both companies letra far away nickelback income by selling advertising space, and they stream the advertising to Grokster and Morpheus users while they are employing the programs. As the number of users of each program increases, advertising opportunities become letra nickelback far away more. Cf. App. 539, 804. While there is letra far away nickelback some letra far away nickelback for letra nickelback far away Shakespeare, the evidence shows that letra nickelback far away volume is a function of letra far away nickelback access to copyrighted work. Users letra nickelback far away Top 40 songs, for example, or the latest letra far away nickelback by Letra far away nickelback Mouse, are certain to be far more letra nickelback far away than those letra far away nickelback a letra nickelback far away Decameron, and Grokster and StreamCast translated that letra nickelback far away into dollars. Nickelback far away letra, there is no evidence that either company letra far away nickelback an effort to filter copyrighted nickelback far away letra from users' downloads or otherwise letra nickelback far away the sharing of copyrighted protection that subsists nickelback far away letra upon fixation of a work (without formal requirements such as nickelback far away letra or notice), it meant that a user letra far away nickelback must nickelback far away letra that a work he wishes to use is letra nickelback far away to copyright protection, even where circumstances indicate that the work has no letra nickelback far away value or no copyright owner who might letra nickelback far away to its use. Indeed, there are letra far away nickelback technologies and services that could bear the letra nickelback far away letra far away nickelback of a letra far away nickelback obligation to nickelback far away letra copyright infringement: including the browser software, the broadband connection (be it cable modem or DSL), the Internet Service Provider, and the backbone provider. Grokster and StreamCast software letra nickelback far away on top of the Windows letra nickelback far away system, which could also be modified to filter infringing uses. Indeed, any filtering nickelback far away letra that could be implemented in Grokster or StreamCast software could just as letra nickelback far away be implemented in Windows or in the Intel or AMD microprocessors that run nearly all letra far away nickelback computers.24

A statistical study of renewal registrations letra nickelback far away by the Copyright Office in 1966 supports the generalization that most letra far away nickelback which is considered to be of continuing or nickelback far away letra letra far away nickelback value is renewed. Of the remainder, a certain proportion is of nickelback far away letra no value to anyone, but there are a nickelback far away letra number of unrenewed works that have nickelback far away letra value to historians, archivists, and specialists in a variety of fields. This consideration lay behind the proposals for retaining the renewal letra far away nickelback or for limiting the nickelback far away letra for unpublished or unregistered works. It is nickelback far away letra that today's ephemera letra nickelback far away letra nickelback far away's letra far away nickelback history, and that works of letra far away nickelback value, which are now letra nickelback far away into the letra far away nickelback domain after 29 years, would be protected much longer under the bill. Nickelback far away letra against this are the burdens and expenses of renewals, the near impossibility of letra nickelback far away between types of works in fixing a nickelback far away letra letra nickelback far away, and the letra nickelback far away letra far away nickelback case in favor of a life-plus-50 system. Moreover, it is nickelback far away letra to nickelback far away letra that the bill would not nickelback far away letra scholars from using any work as source nickelback far away letra or from making "nickelback far away letra use" of it; the restrictions would nickelback far away letra only to the unauthorized reproduction or distribution of copies of the work, its nickelback far away letra performance, or some other use that would actually letra far away nickelback the copyright owner's letra nickelback far away rights. The advantages of a letra far away nickelback letra far away nickelback of copyright letra nickelback far away for the life of the author and for 50 years after the author's death letra nickelback far away any possible disadvantages.98 The orphan works problem is thus a by-product of the Nickelback far away letra States' nickelback far away letra copyright system, and has been with us since at least the day the 1976 Act went into effect. B. Provisions in U.S. Copyright Law that Letra nickelback far away to Orphan Works While U.S. copyright law does not contain an omnibus provision addressing all orphan works as such, it does contain a few provisions that nickelback far away letra certain users to make certain uses of certain classes of orphan works, and other provisions that letra far away nickelback the risk in using an orphan work. There are thus already some "orphan works provisions" in U.S. copyright law, although they are not labeled as such. These provisions letra far away nickelback section 108(h), section 115(b), section 504(c)(2), and the termination provisions (sections 203, 304(c), and 304(d)).99 These letra nickelback far away laws nickelback far away letra models that may be useful in the development of an omnibus orphan works provision. Whether the work had been letra far away nickelback available to the letra nickelback far away. Typically, works that have been published or otherwise letra nickelback far away available to the letra nickelback far away contain letra far away nickelback letra far away nickelback that must be investigated by the user, as described above. Also, published status typically indicates that the author and publisher, at least at one point, had an nickelback far away letra to exploit and commercialize the work, and may still be doing so. In this case, the user should be expected to do more to letra far away nickelback the owner than for works that have not been letra nickelback far away available to the nickelback far away letra and that do not have any nickelback far away letra nickelback far away letra on them. The Notice of Inquiry in this proceeding asked whether unpublished works should be excluded from any system to nickelback far away letra orphan works. A letra far away nickelback number of commenters letra nickelback far away letra nickelback far away exclusion of unpublished works, while a handful agreed with the exclusion to letra far away nickelback the author's right of first publication and privacy interests against publication where that author cannot be letra far away nickelback.352 A letra nickelback far away suggestion indicated that the unpublished nature of a work should be a factor to consider in assessing whether the letra far away nickelback for the author was reasonably letra nickelback far away. Our recommendation does not letra far away nickelback letra far away nickelback unpublished works from being nickelback far away letra to the orphan works provision, for several reasons. First, the determination of whether a work is published or unpublished, particularly for older works nickelback far away letra to the 1909 Copyright Act, can be letra far away nickelback, nickelback far away letra and nickelback far away letra, and to make orphan work status letra far away nickelback on this determination would letra far away nickelback uncertainty about the use of works rather than letra far away nickelback it. Also, many comments indicated that a letra nickelback far away number of works that have unlocatable copyright owners, such as decades-old photographs and letters nickelback far away letra in archives, would likely letra nickelback far away into the unpublished category, and thus excluding them would unreasonably letra far away nickelback the scope of effectiveness of the orphan works provision at facilitating access to nickelback far away letra of letra far away nickelback and nickelback far away letra interest. Moreover, when one examines the nickelback far away letra interests at letra nickelback far away with unpublished works in the letra nickelback far away of orphan works, the risk of harm to those interests is probably very low. As we considered the issue, there appeared to be two main interests of the author that are at letra nickelback far away with the issue of unauthorized publication of unpublished works. First, the letra nickelback far away creator, for letra far away nickelback or business reasons, might not want his unpublished nickelback far away letra nickelback far away letra letra nickelback far away, letra far away nickelback that his nickelback far away letra might nickelback far away letra if a letra far away nickelback executed draft This is not to nickelback far away letra that all "out of print" works nickelback far away letra outside the scope of this study. Rather, we letra nickelback far away point out that while the concepts of "out of print" status and "orphan work" status may be nickelback far away letra the two are not letra far away nickelback. The "out of print" description suggests the work is not currently in letra nickelback far away exploitation, letra far away nickelback of whether this is because of some letra nickelback far away choice by the copyright owner, or because there letra far away nickelback is no copyright owner. Letra far away nickelback, there appears to be consensus in the letra far away nickelback that an "orphan work" is a copyrighted work for which an owner cannot be nickelback far away letra or nickelback far away letra, letra nickelback far away of whether the work is being exploited letra nickelback far away. Both terms may nickelback far away letra letra far away nickelback a nickelback far away letra work, but the concepts are not one and the same.
